I got a tip today that a certain HIV assoiciated group is about to make a push on California Governor Jerry Brown to call for a special legislative session to implement a “total legislative package” to regulate the adult film industry.
This would include testing, mandating condoms and the licensing of adult performers, similar to how Nevada licenses prostitutes.
Now I can hear the FSC now screaming that’s a restraint on free speech…yada yada but they best be VERY careful how they frame that argument because it has been tried in the past and it almost always fails. Right here in Atlanta, for instance, strippers have to have a license from the county to strip, the courts flatly rejected the free speech issue. Advocates for the permits will say that it is no more a free speech issue than filming permits are.
Now I kinda doubt that Jerry Brown is going to call this special session but if you think that is the main goal of the push you’d be….well an idiot, the goal is to raise awareness and drum up support for it for when the legislature does come back in session, and this time I expect it will take more than buying off Mike Gatto to squash it.

In many places all over state California they make massage therapist strippers go get license. That makes them get finger print at local police deparment that has them test for STD deases at health deparment is required none negotiable buy state. If your caught with out your licence if your stripper or massage therapist your in big trouble.
As long as the license isn’t used as a way to regulate content – the free expression of talent – there’s no reason California could not require porn talent to be licensed.
If you think of mainstream, you cannot write for, produce, direct or act in a theatrical, television or film production if you’re not a union member; you cannot distribute content via television or radio without an FCC license; you can’t run a newspaper without a business license. And, hey, states are putting in any number of regulations as to who can and cannot vote – the purest act of democracy and self-expression. Take it one step further, you have to get a permit to sponsor a parade and the Supreme Court has ruled that a parade is a form of protected free speech.
The government could even use porn’s argument about talent as an argument to require licensing. States, counties and cities license businesses. Porn argues that talent are not employees; they are independent contractors agreeing to provide their services. If they are independent businesses, there’s no reason that they couldn’t require them to be licensed businesses.
It just can’t use the license as a vehicle to dictate what can and can’t be filmed as content by the license holder.

It really depends on if you are in the City Limits of Atlanta or not, you would need to call Atlanta Police Permits Office at 404-853-4470 . Also permits are $350.00 and it is a two part process, you have to take a money order for 50.00 first for them to do a background check, on you and then if you pass that then you can go back the following day and you have to give them another money order for $300.00, It is not a one day process so don’t think that if you go up there you will get it within that same day, It takes two.
Also if you have more than 2 misdemeanors within 5 years or a Felony within 7 years they will not allow you a permit, also if you have any drug charges, pending or past automatic No, and same with any Prostitution charges past or pending it is an automatic NO.
So if your adult dancer in California your must have adult entertainer license issued by the police department. So would be no suprise if they did this with porn indusrty. As you can see Atlanta license do through back round check as well charge very hefty fee have one.
There is no such thing as a “state-issued” strippers license. Regulation of these type of businesses is handled by the local jurisdictions (municipality or county). You will have to be more specific about WHERE it is you are interested in working and then check with the licensing authority of that particular municipality.

Producers will be required to keep a copy of the performer license, much like a fight promoter keeps records of the people they hire for events. Lots of stuff is happening now that started ten years ago…stuff that’s getting off the ground now will make itself known in 10 or 20 years.
The industry basically had a free pass until 2004 when HIV showed again. That’s when the game changed and outside pressure decided what the industry did after 1998 wasn’t good enough. Along the way it’s been gearing up with the tide going against the industry on the face of it.
Lots of litigation in CA but they are also fighting in other states. In 2005 looked like 2257 was a done deal yet 2013 a new appeal in Cleveland (OH) Federal Circuit Court by FSC and 14 others. They didn’t win in one place so they try in a new playground.
This fight is gonna get uglier and uglier, doesn’t matter how great a story Rob Black can tell, or how much history he knows, or how many of the players he knows personally as the game has been changing….he has less chance of moving this than I will.
Rob Black is just a guy…as a felon he can’t sit on boards where policy is created. Unless he petitioned to restore his rights he can’t vote.

Actually in some states felons can vote nowadays. I know in Michigan they can if they meet the requirements that anyone else would have to meet (age, residency, picture ID). Also, the city of Flint just elected two felons (one a convicted murderer) to their city commission. I don’t know the rules in CA but it is possible that Rob could serve in government even with his felony convictions.

I think you would be amazed at the number of people who read both the MS site and the comments on a daily basis for a variety of reasons… Mainly AHF, FSC, Producers, Talent, etc.
Although, I still think you’re missing the biggest point:

That is not what I’m here for… I’m not looking for some kind of “approval” from ANYONE!

The issue of performer licensing is one of those “won’t work” concepts. Groups like The EFF will come down the pike and point out that like it or not, it’s creation of art, and is protected free speech. Thus, limiting someone’s right to make this type of art in turn limits their free speech. You don’t even have to squint hard to see it.
The real line is the question of “public place” versus “private place”. It’s very difficult to create law that would essentially stop amateurs from filming themselves having sex and selling it. Trying to draw a line and saying only “professionals” need a license would not pass the general legal sniff test, it stinks of prior restraint.
I suspect this little push comes form the same group with the fake letter from a few months back. Lots of huff, very little puff.

What does a performer getting licensed have to do with not being able to create art? Or, how does it limit free speech exactly?
One can still work “with” the government and not be a part of them. There are a lot of things out there already where that is the case. I’m not suggesting that Rob will be part of the government. The UAWA isn’t going to be the government and Rob isn’t going to be a government employee.
On a side note if you have the right connections you can have felonies and get a government job, but I think it becomes a problem if the job requires you to carry a gun. There are felons that work for the government, but very few. The employment process of every person has to be evaluated. The government can hire felons, but they don’t do it that often. Someone has to pull strings for you.
If Rob did head to Sacramento for meetings with officials then there was a reason for it. If there aren’t plans to involve Rob somehow then why would they be interested in talking to him? Why would they waste their time even if they just wanted his opinion? It wouldn’t hurt to sit around and wait to see what happens.

I would like Rob to be successful, but his public behavior, five hours a day, is the biggest roadblock to his own success. It appears to me that he spends more time pushing people away, the very same people he wants to represent, than reaching out to them and building a solid platform on which to initiate change.
I just dont see Rob reaching out to people. You cant call people retards and then expect them to line up behind you, its that simple. I hope when Rob reads this he sees it as a challenge to do better, constructive critisism. I would love nothing more than for him to prove me wrong. This article appears to address some of the comments I have made here. And this article contains a perfect example of why Rob has not been successfull in getting performers to back him.
Rob asks,”Who are the industry leaders”(in so many words) Well here you go Rob, the answers you’ve been looking for. You need veteran talent to back you. You need the likes of Lisa Ann, Jenna Haze, Belladonna, Evan Stone, Lexington Steele. You need performers who others respect, who are successful. You need to reach out and INCLUDE people.
Charity Bangs is a great example. On this very site I have pointed out the flaws in her plan, but you Rob need to reach out to performers like her, not ridicule her. In my opinion you should have reached out to her and said,”Thank you for wanting to make change for performers. Thank you for speaking out, I hope we can get together and talk about what you think can be done, maybe we can find common ground, maybe you can talk to other performers and get ideas from them. I need performers like you who want change to come together and reach out to other performers.

With the holidays approaching so is my research deadline. I got wrapped up in putting the pieces together matching facts here and there which is good for policy but not when commenting along the way. I agree. I still think that Rob has something in motion that we don’t know about or the whole truth, but being a little nicer may improve reactions to what may occur and to get more breaks. At times you have to power down the shtick. If done correctly he could make it quite effective.

If the only way you can create art is by obtaining a license, that by definition stops some art from being created – or at least delayed. Think about it in simple terms: if you cannot freely speak without a license, or face legal action for exercising your free speech without said license, then that speech is impeded.
I want to make a porn movie right now. It’s art, it’s protected free speech. But wait, I can’t do it until I fill out the right form, get a government license as a performer, and if they approve of the license, then I can consider making a porn movie… that stops my immediate free speech.
Moreover, if the licensing process makes people not want to make the “art” in question, for whatever reason (too time consuming, don’t want to register, whatever) it is a clear chilling effect on free speech.
Free speech delayed is free speech limited.
Generally, the legal argument for registration is that it furthers a public / government interest, in this case a health and welfare issue. But there is no indication that forcing adult movie performers to obtain a license to be a performer would advance that agenda, and the harm to free speech created by such prior restraint / chilling effects is much more significant than any public good that can be advanced.

I think it goes more like if you want to perform art of this nature then you have get a license and the guy who tricks out an old caddy has to do the same to drive it in a show.
If you get the license then doing the art isn’t impeded and with safety regulations in place then the licensing can be validated. Can I go and light fires in a pattern on the ground on my own property in the name of art or do I have to get permits to do so? I’m going to need permits to burn my lawn. Are they interfering with my art process? No. They’re just making sure I don’t burn my house down and the neighbors with it.

@CPanzram: nope, you are confusing a right (free speech) with a priviledge (driving). Making a porn movie isn’t a priviledge, it’s a free speech right. Making a porn movie is no different from writing up your “world domination” tract and handing it out on a street corner. It’s free, protected speech.
As for your lawn example, you have to understand that your rights to do with your own property end where they can affect the rights of others. Burning your lawn for yourself isn’t a real issue, the smoke and such caused by it creates a public harm and thus, isn’t the art issue, it’s the pollution issue, the safety issue, and so on.
None of your examples are free speech examples.
Could you imagine a world where you have to get a license before you can buy a computer, because you MIGHT type something, you might express yourself? How about a license for a video camera, where you have to have a university degree in order to have access? Perhaps a manditory licensing fee for the use of a photocopier or making duck face pictures for face book… all good examples of things that could be regulated if you regulate other forms of free speech art.

Had an interesting convo with a constitutional expert…left Me dazed and confused of course.
He makes several points….the chilling argument for licensing isn’t made by performers it is made by employers to whom it would not apply as the employer isn’t chilled because their performer is licensed.
Cam models might be chilled but as a solo would not need licensing and therefore would not be chilled…oh he went on and on..
He previously brought up many points of artists being limited by the use of their medium, restricted to to time and place…sculptors, welders, hazardous materials and more and license requirements to use materials in pursuit of their art. Where it was held that it was NOT a chilling effect.
He brought up artists who wanted to continue use of hazardous materials and were denied…under the equal…he keeps laughing at me saying “dear remember the first amendment may give freedom but it is the constitution that makes us equally free to pursue those freedoms.
Trust me..this guy knows case law…it’s his porn!
Basically the FSC has a good argument why artists shouldn’t be chilled but forgets performers are employees. And as employees are already chilled. So the conundrum continues.

Don’t confuse workplace rules (ie, OSHA acts) with licensing acts. Specific requirements for the employer to provide a safe work environment and all stand no matter which way this particular wind blows. If your take on Treasure Island is correct, they would certainly be a likely candidate of OSHA style action, no matter what. Again, willing participant or not, knowingly providing an unsafe work environment is enough to get the employer in trouble.
Remember that obscene or illegal acts are NOT protected by the first amendment. Try to remember that, it’s very important. Material that is considered obscene or that is illegal does not come with the same protections.
You are going a long way to avoid the simple point: Licensing would make it illegal for just anyone to pick up a camera and fuck for cash, pure and simple. Girlfriend videos? Home made porn? Camgirls? Forget about it. They would all need to be licensed professionals to work. No more “stolen” porn movies, because there is no way that Kim Kardashian is going to get a pornstar license to be able to see her next master work (and you can tell it’s coming one day). If those people’s right to express themselves is limited, then they are victims of prior restraint.

Not confused…this is to address performers in adult films who are in fact employees. This isn’t about regulating the art it is about workplace safety. Look at what the licensing bill is for…then go look at history. Look at march 2012 meeting at OSHA where FSC has two lawyers fighting to keep OSHA from doing a policy that clear up EMPLOYEE because they like using the ambiguous camouflage of obscure and unrelated case law.
Solo Cam girls would not need a license…they are not employing (using) any other human (Aka hazardous materials) in the pursuit of their art. But the moment they wanted to bring another human onto their camera a license would be required. No different than an artist who uses hazardous materials….don’t forget the EQUAL part of what holds up the freedoms. Other art forms must be licensed to utilize the hazardous material of their creation.
Despite all the diseases of the human body we can probably be glad it isn’t asbestos…look what happened to the insulation industry. Before we had tyvek we had pink fiberglass to replace it. This isn’t a first amendment issue it’s a COGS issue.
This has been a pretty spirited discussion. Some of it has focused on the First Amendment, as did a lot of the discussion on Luke Is Back and statements by James Deen and others about condoms.
When it comes to the actual issue of porn, almost all of that discussion is misguided even if it is passionate.
Now, I wrote something like that on Luke Is Back a year or so ago and got flamed, including a response by the Colonel – or whoever that guy was – who said he would try to explain things simply to me but I was probably too stupid to even understand so why bother.
Now, that guy may have had a point – my wife says I’m probably too stupid to understand on a daily basis, and she knows me better than anyone but my mom (who likes her more than me).
So, don’t take my word for it. Read the actual lawsuit that Vivid argued in court and then read the opinion of the federal judge who found in favor of the law.
If you read the suit filed by Vivid, Kayden and some guy who didn’t even know why his name was in there, what you’ll find is that they barely mentioned the First Amendment.
The heart of the Vivid suit was an economic argument. Vivid said the consumer does not want to watch porn with condoms and its business will be adversely affected.
Kayden said that she films scenes for her website in her home, which is a jurisdiction covered by the law. If enforced, she would have to rent locations in areas that are unaffected by the law to shoot condomless porn and she couldn’t afford to do that. She’d be out of business. So much for Kayden making so much money, she can retire from porn and never make a day in her life – a location fee is going to break her bank.
The guy said that fewer scenes would be shot, hence, he would have fewer opportunities to work and would have to get a real job to pay his rent.
As to the judge’s opinion, he said that porn mentioned the First Amendment in its argument, it was highly unlikely to prevail on that argument, so lets move on. I just gave more attention to the First Amendment and the condom issue than a federal judge. Now, that may not seem like much to you or I as a laymen, but if you talk to lawyers, they will tell you should read a judge’s casual dismissal of something as if it was written in all caps, underlined, bolded, highlighted in yellow, and delivered at the top of his lungs. He’s telling you that you just wasted his time.
Finally, the judge rejected most of porn’s economic arguments. The one bone he threw to porn was economic.
So, again, to anyone who wants to shout about the First Amendment and regulation of porn, read what your industry actually argued in court and what a judge has actually said. At least when it comes to condoms, the industry did not make much of a First Amendment argument in court and the judge threw it out the window.
Now, when it comes to licensing talent, porn cannot make the same weak economic argument it made about condoms. Talent and not the porn industry will probably pay the license fee. And, unless government does something stupid like say you have to pay a $10,000 fee to be porn talent, it will only be a hurdle to 18 year old high school drop outs – who can make back the $250 or $500 fee with their first onfilm blow job. The Lisa Anns of the world may grumble, but they’ll pay it easily.
Second, there’s been some discussion here about art, prior restraint, etc. Here’s the thing: The First Amendment does not guarantee freedom of art. Again, don’t take my word for it. Google the First Amendment.
It protects the free expression of religion, the right of the press to operate without government interference and the right of individual speech. The word art does not appear in the amendment.
I could be wrong, but I believe that is probably because of the old phrase: Art is in the eye of the beholder. The government cannot say what is and what isn’t art. So again, the First Amendment does not define art or protect art. It protects speech.
Now, porn cannot argue that it is a religion – I may like a big booty, but Jules Jordan’s Ass Worship is not one of the sacraments.
Likewise, in the age of the Internet, bloggers and special interest websites, the law has been challenged to define just what is the press and who is a reporter. It has struggled with that. But, the general test has been whether a reporter or organization is reporting or opining on the important events of the day. I believe AdultFYI, Mike South, AVN and other industry sites would find freedom of the press protection under the law. Love them or hate them, they have both reported and commented on the events of the day. The condom, OSHA and now licensing debates are great examples.
And by the way, the government is allowed to issue press passes that restrict who can perform their reporting duties at the White House or in Congress. It can’t stop me from launching a blog to write opinions about the Congress or the President, but it can prevent me from getting a press pass. That is similar to a license.
That leaves speech. Now, we have pretty broad liberties when it comes to personal speech. We can say or write just about anything and hold about any opinion we want as long as its not injurious to the public. You can’t yell fire in a crowded movie theater and you can’t put up posters that claim your neighbor is a meth-addicted child molester who eats cats just because he broke your snowblower.
Commercial speech, on the other hand, is highly regulated. The FCC can tell CBS that a character in a sitcom can’t say fuck on network TV or that a singer can’t flash her breasts during the Super Bowl. Someone mentioned prior restraint – that means that if the FCC knows CBS is going to say fuck on TV it can’t prohibit CBS from broadcasting the show. But it sure as hell can fine CBS after the fact. The FTC exists to review advertising and determine whether a company lied to the public. The FTC cannot file criminal charges, but it sure as hell can fine a company that lied to the public. Commercial speech is regulated like crazy.
So, where does art fall. Since we can’t define art, the performing arts fall under the umbrella of protected speech. However, when speech intersects with the interests of the public or is done for a commercial purpose, the government has a right to regulate how the speech is delivered. That right has been upheld over and over again.
Stripping is a great example. Stripping has been upheld by the Supreme Court as protected speech. A man or a woman has a constitutionally-protected right to take their clothes off to express a message. It’s in the law. You can look it up.
The government is allowed to regulate where that stripping takes place. In most communities, a stripper couldn’t do her act on the town square at high noon while her suitcase pimp passed around the hat as if she was a folk singer.
The government has a right to pass zoning laws that limit where adult entertainment businesses can be located. It can’t do that retroactively – that’s prior restraint. In other words, if I open a strip club next to a church, city council can’t retroactively pass a zoning law that prohibits locating a strip club next to a church. But it can do it proactively so that the next guy can’t do it.
The government has a right to control the stripper’s message by restricting how much clothing he or she can remove during their performance or whether they must wear pasties and/or a G-string. And remember, the Supreme Court has said that jurisdictions can restrict the sale of pornography and sex toys in their communities if they want.
Finally, the government has the right to license strippers – the right to regulate who can express their message in public by taking off their clothes.
Making porn is no different than running a strip club in the eyes of the law.
Now, someone will make the argument that a movie is different from stripping. The First Amendment does not – and government cannot – make a distinction that one form of protected speech deserves more protection than another form of protected speech. If that were the case, Rand Paul would have the right to stand on my town square and spew all kinds of stupid shit because he’s a US Senator, but the state could say I can’t say the exact same words because I’m an idiot.
Similarly, the state cannot say that Stripper A can get a license because she’s got a great body and is a really good dancer but Stripper B can’t get a license because she’s old, ugly and pretty clumsy. Stripper A’s message is given the same level of protection as Stipper B.
Protected speech is protected speech. Francis Ford Coppola gets the same protections as Bugs Bunny. At the same time, Francis Ford Coppola faces the same regulations as Bugs Bunny. He doesn’t get a pass on his sets because he’s a genius and the other guy is making a cartoon for kids.
I have no idea whether the state of California or Los Angeles County has any interest in licensing porn talent. My theory has always been that porn gets a pass because it is distasteful. No professional wants to be on jizz patrol. So long as porn did its business behind closed doors and there were no dead bodies on the sets, no one wanted to know about it.
Porn is getting the attention it is getting now because porn is pushing the envelope, people are getting hurt, and people are getting infected.
California may end up with no interest in licensing porn, despite the sorry state of its finances. But as long as it doesn’t use the license as a way to regulate content, there’s no First Amendment reason why it can’t do so. In other words, the state can’t issue a license that says: Lisa Ann, you can give a blow job, but you can’t have vaginal sex based on this license. That’s content.
Again, the First Amendment talk that was spouted by talent like James Deen sounds great and is fun to argue about. But, read the lawsuit filed by Vivid and read the judge’s decision. Porn made an economic argument. Not a First Amendment argument.

Pointing out that I think Nick’s book is a little out there isn’t really an attack. It is what happens in the real world when people see a published work that is being peddled at them with a premise based on angels and ying yangs. Nick can prove me wrong by providing me with a copy of the Orion Compass which is available in eBook form on Amazon for 4.99. I’m sure it will be more compelling than a Nancy Drew novel.
I have nothing against Nick. He advertised the book and I responded with my opinion. Throughout the years I’ve learned that those relying on fictitious beings for guidance may not provide the most solid advice. How do you know I’m not his guardian angel and feeling remorse for the advice I provided him years back when I was inebriated? Those could have been dark periods for the both of us.
I’m unaware of a tallying system that would provide me the information needed to determine if I’m Rob’s #1 fan. He provides me entertainment at work and I think he’s doing more than others to help the business. As jilted said there are tactics that he can use which would provide greater acceptance, but his show is more entertaining than any other person in adult with a radio show. I think he has a plan and I wouldn’t underestimate him just yet. He comes across as someone that would stop at nothing to have the last laugh. Those are the ones you have to watch out for.

@Nick…. to address your question….I really don’t know what to believe when it comes to Deen stating he’s never had an STD…it seems very unlikely to me, from what I read stds are very common amongst performers, so I have no idea how he would have escaped getting even one…. If condoms were always used I would more likely believe it, but we know that’s not the case (though he does state that he always uses condoms outside the testing industry in his personal life)…..I worked for Planned Parenthood for many years so I have a good working knowledge about how easily STDs can be spread…. why he would feel compelled to put out false information, if it is indeed false, is something I find perplexing and wonder the benefit…..he seems like a very forthcoming guy

Finally, and most importantly… You guys who are actually deep inside the porn industry might want to pay some attention to what outsiders think. Don’t know if you realize it or not but “the industry” is no longer making it’s own decisions. The various city, county, and state governments are taking that decision process away from the industry. Screaming your opinions as fact, calling people names, spouting outlandish conspiracy theories about paying trolls, to try and win internet pissing contests on a porn blog isn’t going to change that.
The reason I name the three of you specifically is simple. I’ve been reading and commenting on this blog for at least five years, maybe more. I’ve never seen the kind of bullshit you bring to the table. I enjoy reading most of the posts and comments. Whether I necessarily agree or not, there’s almost always something I can glean from the discussion. With you three, it always degrades to the same tactics… anyone who disagrees with you must prove who they are, or they’re obviously some troll hired by the FSC or the devil or whoever. Do you really think that much of yourselves? Why would anyone pay good money to have someone discredit you, when you all do it so well yourselves?

Laura: To your question about mandatory condoms and freedom of speech, that is a position that porn has taken on websites and in press statements. However, that was not the central argument porn lawyers made in the Vivid lawsuit challenging the law. It was in there, but it wasn’t the heart of their suit. And, the judge dismissed that out of hand saying that they were unlikely to win on First Amendment grounds. The central argument in the Vivid case was economic – producers and performers would lose money because the consumer doesn’t want to watch porn with condoms. The judge rejected that argument as well in upholding the law. Vivid has appealed the decision to the 9th Circuit Court Of Appeals. This is considered the most liberal federal appeals court in the country, so it is the venue where they are most likely to have success. On the other hand, if they lose at the 9th Circuit – or if the 9th Circuit simply bounces it back to the original court for another look – they’ll be in tough shape. To win on appeal, you can’t just say that the original judge was wrong or that you don’t like his decision. You have to demonstrate that he was wrong under the law. So, if you read Vivid’s appeal, you’ll see that there’s a lot of discussion around First Amendment issues like prior restraint. However, the heart of their appeals argument is that the judge was wrong in how he interpreted the condom law – they accuse him of essentially rewriting the law so that it is constitutionally valid. In other words, they say he over-stepped his legal authority. The way they use prior restraint is not the way the James Deens of the world use it. Publicly, porn has said that requiring them to use condoms forces them to change their message – watching sex with condoms sends a different message than watching sex without condoms. Prior restraint means that the government can’t prevent you or I from saying something, writing something, publishing something or broadcasting something that may be objectionable or against the law. They can’t restrain us from exercising our First Amendment. Instead, they have to let us do what we want to do, then they can bring an action. You can’t say Fuck on network TV. So, let’s say the government gets wind that Max on Two Broke Gals is going to say she really wants to get fucked on next Tuesday’s episode. The government cannot go to CBS and say: We’ve heard this is what you’re planning to do. That violates the law, so we’re going to prevent you from broadcasting. That’s prior restraint. However, the government can come down with everything at its disposal against CBS after it broadcasts the objectionable scene. It just can’t restrain it prior to broadcast. That’s a First Amendment issue.
What’s all that got to do with Vivid? The way they are using prior restraint is to say that the requirement of having people trained in blood-borne pathogens, forcing them to get permits and posting those permits during shoots will limit the number of shoots. Or, in the case of Kayden Kross, it will force her to stop the production of pornographic content because she shoots in her home which is in the affected area; she doesn’t want to use condoms; and she doesn’t have a budget to rent locations in an unaffected jurisdiction. It is restraining her from being a pornographer. Logan Pierce says that he will have fewer opportunities to act because there will be fewer shoots – thus you are restraining him from expressing himself on film.
However, they aren’t really making a content-based argument. It’s a little odd.

Yes – they are really making an economic argument but calling it prior restraint. Again, in an appeal, you can’t just say you don’t like the judge’s decision or that you think the judge was a bonehead. You have to say that the judge was wrong under the law.
I’m not privy to Vivid’s legal strategy, so I can only go by what I read. But, the judge dismissed the First Amendment argument out of hand. He said, unlikely to win a First Amendment argument. That gives Vivid an opening to say: Well, that’s just wrong. Producing porn in California has been held to be legal, protected speech. So, anything that restricts our ability to produce legally-protected speech is a prior restraint.
Now, the judge found that under the new law, you can have all the pussy-pounding, ass slamming that you want as long as you’re wearing a rubber. He made no content-based decisions.
As a result, Vivid isn’t making content-based arguments. They are not saying that making Lisa Ann take it in the butt with a condom is limiting her right to express anal sex the way she wants to or that it’s going to dry up the market for creampie videos. That would be a content-based argument.
I think there’s a good reason for that, too. The courts have consistently found that obscene material is unconstitutional. The court has been reluctant to define obscenity beyond child pornography, bestiality and excrement.
This is a case that could go all the way to the Supreme Court, especially if the state wins this appeal. I believe that Vivid, like Larry Flynt, will argue this all the way to the Supreme Court.
We have a pretty conservative Supreme Court. At least two members are openly hostile to pornography – Scalia and Thomas. Two more members are very conservative. Kennedy is a swing vote. If you’re Vivid, do you want to swing for the fences and throw the dice on whether one of the other five wouldn’t find the most disturbing acts on film unconstitutional, especially when those most extreme acts may also be the best examples of why you need condoms? Remember that in a Supreme Court argument, you can get briefs from friends of the court in support of one side or the other. There are any number of very smart, very well-funded anti-pornography groups that would love to argue that Kink.com, or the double-anal pounding taken by Julia Ann, or the 50 man anal cream pie are obscene and unconstitutional.
So, instead, they’ve made this a restraint based appeal. In fact, Vivid tries to dismiss the public health argument pretty quickly. It argues that the industry has a stellar testing system, a fantastic public health record, and even if talent is a swimming cesspool of disease, you can get around the condom requirement by setting up shop in a neighboring county, so you’re not protecting the public health.
That brings them back to prior restraint. Government is not allowed to pass a law that abridges – restrains – the right to speech. If you pass a law that restrains people’s abilities to express themselves sexually because the law kills the market for that speech, you’ve restrained speech.
I’m not saying I agree with that. Only that if you read their papers and boil down the mumbo jumbo, that’s their argument. Kayden Kross’s argument is that she lives and works within the jurisdiction covered by the law. Her livelihood depends on her ability to film scenes in her home and post them on the Internet for her website members. She has no money in her budget to rent a location in a jurisdiction not covered by the law. If you force her to abide by this restriction, she will go out of business because she does not make enough money to rent a location.
Logan Pierce argues that he expresses himself by performing in porn. If you enforce this law, there will be fewer opportunities to perform – for instance, his good friend Kayden won’t use him because she’ll shut down her website. So, you’re restraining his right to expression.
Vivid’s best chance of winning is in the Ninth Circuit Court of Appeals. It is the court most receptive to these kinds of arguments. That’s the good news.
The bad news is that the 9th Circuit is over-turned by the Supreme Court more often than any other appeals court. The other bad news is that if Vivid loses in the 9th Circuit, its chances of winning on a Supreme Court appeal are slim to none. If you can’t win a First Amendment porn argument in front of a group of bleeding heart liberals, do you think you’re going to win in front of a group of guys who look like medieval executioners?

Didn’t Kross argument also have to do with privacy of the domicile? Heard that come up last night in the boozy haze before neighbors got arrested for d/d when he thought it would be a good idea to try wireless projector against side of house …yeah it was porn and I now know what Deen looks like in all his glory lol. ..anyway before attorney Bob went to bail out the drunken fool he was detailing the rights of private homeowners (to about 6 cops and 200 peoples amusement we now know they don’t extend to showing movies against house…and folks won’t let me live this one down anytime soon:) but what I took away was it would encourage government to enter homes looking for condom use if a camera was being used with presumption that it was a production. Lots of good fun & debate at any rate.

@ LurkingReader – I think the privacy issue was in the original lawsuit. It’s been a long time since I read it, but the one thing the judge ruled on in porn’s favor was that aspects of the law gave the government to much leeway to do inspections. It may still be in the appeal. If so, its buried near the end – and I didn’t make it all the way through. It’s not a primary argument.

Not only do we feel much better physically, food tastes better, and smells are more pronounced, but for me at least, there is a great sense of liberation in not being controlled by the habit. Rob Black is finally starting to see the folly of his ways. Yesterday he said, “Take everybody following Rob Black out. We know nobody is going to go on the record and say “I follow Rob Black.”
Rob has painted himself into a corner, and now there is nowhere to go. You cant be leader unles people will back you, and even Rob knows that nobody is going to follow him.
But he still doesnt fully get it. He continues to spout that he is the only one addressing these issues, and taking credit for things he had nothing to do with.
Rob could have made a real difference, but he thinks that he is more important than the issues at hand. He has the mistaken notion that talk is equal to action. How can Rob seriously try to convince people that he should be the industry leader, the head of UAWA, when he knows nobody will follow him?
Rob, you arent more important than the issues. Maybe you dont realize that you make it seem that it is more important that Rob Black is talking, than what he is talking about.
