I was contacted by Kink.com and asked to run this.  In the interest of full disclosure I am happy to do so.  However you may feel about Kink or Peter Ackworth I do feel that they have a right to have their side heard same as everyone else.  I take issue with some of the statements, like the no on set transmissions since 2004 but in fairness i am running this without rebuttal.
For the record this was a polite request, no threats or anything of any kind were made.

On Kink.com’s Shooting Protocols

Last week, a performer tested HIV+ through the industry PASS (Performer Availability Screening Services) system. We immediately halted production while performers could be re-tested and protocols examined. We take the health and safety of performer’s extremely seriously, and no matter where the performer contracted HIV, it’s our responsibility to make sure our safety protocols are inviolable.

In this case, as they have for Kink’s entire history, the protocols worked. (Despite filming thousands of scenes each year, the straight adult industry itself has not seen an on-set transmission of HIV in the United States since 2004.) But that hasn’t stopped fear-mongering, HIV hysteria or willful misunderstanding of what happens on a Kink set.

I do not want to attack those who are concerned about condoms on adult sets or those who believe that our protections are not enough — those people, too, are concerned with safety of adult performers. But it’s important for me to talk about how we conduct ourselves at Kink.

For kink.com’s gay sites, all shoots are condom-mandatory. On the straight side, we only work with performers shown cleared for work in the PASS (formerly APHSS) database. This means they have tested negative for a slate of STIs in the last 30 days, including HIV via the highly sensitive RNA test.

All of our performers have the right to ask for a condom to be used at any time during a shoot, for any reason. Earlier this year, in response to performer feedback, we instigated a double-blind condom policy. Performers confidentially choose whether they want condoms to be used, and when directors hire a performer, they do so without knowing that performer’s condom preference. (Some of our biggest stars, like Lorelei Lee, consistently use condoms.)

On sets like Public Disgrace, which are open to non-adult performers, we do not allow anyone who has not been tested to do anything that might transmit an STI. If a performer has indicated in writing that he or she is comfortable with it, we allow these persons to perform activities such as touching, slapping or fondling, but this is entirely up to the performer. Negotiated consent is the central tenant of BDSM, and it’s part of the foundation on how we built Kink.com.

These past few years, we have worked closely with the STD Prevention and Control division of the SF Department of Public Health on training for employees and providing a safe workplace. We also host free bi-annual screenings and STI counselling for all local performers whether from a studio or independent. We have documented Blood Borne Pathogen and IIPP protocols which include rigorous cleaning of all toys used etc. We carry worker’s compensation insurance which covers all performers. And we’ve worked with Cal-OSHA to do on-set inspections. We are committed to helping keep our community stay safe and healthy.

This particular performer performed at Kink.com on July 31st. She tested negative on July 27th via the most sensitive HIV tests available, and was thus shown as cleared for work in the PASS database, as were all those persons she performed sexually with. Additionally, those same people she performed sexually with tested negative for HIV again after that July 31st shoot.

Anytime someone tests positive for HIV — whether an adult performer or not, whether through sex work or not — it is devastating for the person concerned. However, that doesn’t mean it should be a reason to demagogue from either side, to blame the victim, people’s sexuality or what they choose to do for a living. We work hard to protect our performers, and it’s important to us that anyone in the Kink family — fans, performers or staff — know the truth about our protocols and standards.

If anyone has any questions about the particulars, I’m happy to answer them. But the issues are too serious to allow opinion, speculation and politics to take the place of fact.

    HIV hysteria? What the fuck????? People are getting HIV! Excuse some for being hysteric about this fact.

    You only test on the straight side? That’s what your statement said. Why may that be? Could it be because a lot of the only-gay performers are HIV positive? How many are on viral meds that also work in straight? Can you at least provide us with a number of your performers or at least be able to state that there is one taking anti-viral meds? Or didn’t you think about that?

    At any point do you spend enough time with the model to understand that she actually wants to be injured? Last time I checked the BDSM community strongly frowns upon doing something like cattle-prodding people without knowing a lot about them first. If you don’t agree, then you are a dickhead.

    Also, you seem to point out a lot about consent. What if the girl is obviously making poor choices? Do you interfere or just use the ruse of “she consented” so you can have a scene and make your money? With what you film doing so can result in great harm to performers that clearly did not consent. With your apparent use of cocaine could it be possible that performers are coerced through scenes with cocaine? I would love to see all of the footage of the performers that redded-out and you didn’t finish the scene and had to scrap it after only 15 minutes. Those in the BDSM community know that those kind of scenes can be common. Where on your site can we get this kind of footage? Will Jules Jordan be selling the DVD’s with this footage in the BTS?

    Since there is a chance Bay could have become positive on your set are you going to release her footage that you shot in that time frame on your site?

  2. @CPanzram: kink.com scenes all include interviews with the performers before and after the scene. They DO know if electrostim implements such as cattle prods or violet wands are part of the scene. They DON’T have to agree to have anything used on them that they don’t WANT used on them. Kink.com has been around for a long time. You may not like their content, but there are many female performers who enjoy being the sub in BDSM scenes.”What if the girl is obviously making poor choices?” How would you determine this? Have an on-set psychiatrist do an evaluation on every sub performer prior to filming? Whether or not she is making a “poor choice” is really not anyone’s place to judge. If she is obviously drunk or on drugs, that would be the only reason to not allow her to shoot. They ARE consenting adults, there is extensive paperwork required before a performer can sub in a kink.com scene, and I already mentioned the interviews. I think a strong component to many of the objections to kink.com’s content is that many people simply don’t believe that a woman would willingly subject herself to extreme domination that she could possibly enjoy it.

    What about brenn wyson who worked for kinks divine bitches around the time he was diagnosed with hepatitis c and was shocked that his scene partner in a kink gay shoot wasn’t told in advance.

    Sorry Peter but if you don’t test on the gay side and you are allowing those guys to cross over that’s fucked up. Do you not think those guys are fucking johns raw for a few hundred bucks extra?

    The extreme sex acts and easy transmission of blood and other fluids should tell you maybe you shouldn’t let crossover guys shoot extreme scenes with female talent.

    After seeing what your talent did to cameron bay during that shot and some of the other injuries and lax policies you have you have no credibility at all on performer safety.

  4. @sachertorte do you rally think its ok for kink to use male talent who shoot untested and unprotected gay porn. A gay performer who shoots bareback stupidly said that he only works with guys with low viral loads and also commented that most of the talent in bareback pirn is HIV positive. A week old test doesn’t mean shit if the male talent took multiple loads in his ass a few days before.

  5. @CPanzram: additionally, many of the scenes shot by kink.com come directly from female performers who approach them with their OWN ideas for a scene. For many of them, it’s carrying out a long-held fantasy. I know that this concept seems alien and perverse to some, but it’s reality. Wealthy men pay for private sessions with dominatrices, and that seems acceptable, but idea that a woman would desire anything similar offends and disgusts some people. There is a REASON for the popularity of the “Fifty Shades of Grey” series among so many women. And lest you think this is a biased viewpoint coming from someone with a kink.com membership, I can assure you it’s not. My viewing preferences are actually quite “vanilla.” But I don’t judge those who like kink’s content.

  6. @:dodogoodman: I never implied that ANYONE on a porn shoot should work untested. As for “crossover” bisexual performers, the reason kink uses them in their femdom shoots is because most straight male talent flatly refuses to do femdom as they believe it would damage their “macho dude” images. James Deen makes the excuse that he doesn’t “get turned on” being submissive, but it’s really all about his image. As for one gay performer’s claims that “most of the talent in bareback porn is HIV positive,” it would be helpful to see some stats backing up his claim.

  7. @sachertorte I doubt you will find much in the way of stats on that since almost none of those companies test at all. For years in the gay side of the industry if you went over to bareback it was assumed that you were positive and essentially blacklisted from coming back into mainstream gay porn. The point is that those guys work with untested talent, work raw with those guys and there’s a very good chance they very well aren’t using protection with clients.

    Kink is putting talent at risk with fem Dom scenes and I don’t think that can be disputed. If there was full disclosure about this I would bet a lot of these girls wouldn’t do the scenes. I also think brenn wysons hep c diagnosis and the non chalant attitude that kink and his agent Howard (who was also the agent of Derrick Burts) had about his condition does not reflect well on this company.

    If kink can’t find talent that doesn’t put their performers at an extra risk perhaps it’s time divine bitches and ts seduction shut down.

  8. @sachertorte: Extensive paperwork? You mean paperwork that covers Kink’s ass, right? You know, like how the girl can’t sue if she gets burned or has to require vaginal reconstructive surgery. Women consent to that so it’s OK. Right? I wouldn’t say it is anyone’s place to judge either, but it definitely should not be Acworth or anywhere that the cops can find cocaine and guns. They may not be in the best mindset to do what they are doing.

    Ever read 50 Shades of Grey? It is contractual BDSM. It is romantic. It wasn’t real. Kink.com is actually hurting women. Like I said, show me the footage of the girls that couldn’t take the abuse and the scenes had to end. There should be a lot of them. Katie Summers said she was burned. Twitter her and ask if she consented to be burned and have her skin broken.

  9. A lot of the conversation around Cameron has been hysterical, and I think there’s been victim blaming. HIV is a serious subject, and we need to discuss it in a way where frank and honest about how it’s transmitted, how it’s not and what the risks are. Otherwise, we all look uncredible. As a gay man, I’m shocked at how ignorant some of the comments about HIV are and quickly a witchhunt develops. We need to protect models, but it does no good to act like they’re radioactive.

There’s always such a distinct difference between statements made freely by Peter when he’s been unsupervised on his computer and when something has been written up by someone on the employ and that’s a good thing. Nevertheless, I have to roll my eyes at the notion of a ‘double blind’ hiring process at a porn company. Firstly, most of the directors are hiring people they are already personally familiar with and secondly, if they aren’t it’s not as though anyone is unexposed to the constant stream of images every performer is putting out there to hustle for work. There is nothing ‘double blind’ in an image based industry. Moreover, if this were the case the shoots themselves do not statistically represent an even spread from double-blind hiring practices. It’s nice in theory but hiring decisions aren’t made by a randomly generated pool. It’s unrealistic to expect a director to divorce themselves from familiarity and no one is shy about advertising all the ways they fuck. That’s how you get hired.

    Now, I’m in the unpopular position of being married to a ‘cross-over’ performer. Don’t worry, Los Angeles. He moonlights rarely in porn beyond our own little indie clip operation, never in Los Angeles, and only around his graduate school schedule as he finishes his PhD in physics. I love him, he’s a queer guy, and he’s one of the very few who only works with a condom.

    This is relevant because when I was following up on the recent positive in the industry here on this website when I noticed a posting from Brenn Wilson talking about having Hep C and working with Kink.Com in 2011. My husband shot with Brenn at Kink.Com in 2011. We heard neither hide nor hair about any possible Hep C exposure.

    It would have been so simple to send a simple email out to performers that read, “Typical industry testing does not cover testing for Hepatitis despite the fact it is a potential risk from shooting pornography. We care about the health and safety of all of our performers and we would like to remind you that there is free Hep C testing available at numerous locations in San Francisco and we are happy to provide a list for anyone interested.” It didn’t have to name anyone. It could have just been a head’s up.

    That head’s up would be helpful because my husband has also been booked for B/G shoots. He received a booking for a gangbang and having heard that from people who had already performed on that site that it was mandatory condomless, he told the booker that he would require a condom. On the phone he was told that this website was not mandatory condomless, it was “just a fantasy site that features condomless sex.” I had to write that line down because it wins the Olympic Gold for verbal gymnastics.

    Kink.Com has this tagline where they claim to ‘demystify sexuality’ but all of their press releases obfuscate the issue. My only dog in this game is a performer’s right to use a condom and not experience workplace discrimination for it.

    On the model rights section of the website, it states that models have the right to ask that fresh condoms be applied to any items used on them. It’s a shame that there is no bullet point for a performer having the right to ask that a fresh condom be applied to a cock that has blood pumping into it and semen coming out.

    All of this would matter less if Kink.Com didn’t insist on acting as the paragon of industrial ethics. Every one else owns up to the fact that condoms are selected against for whatever reason. What kills me is that whether or not the dick is wrapped, the porn is going to be pirated anyway. In fact, the few people with the ethics to pay for porn remaining probably aren’t the ones who are going to object to condoms any way. It takes less effort to find all of these shoots for free on a torrent website than it does to pull out a credit card and pay for it. No one knows how to get around that fact just yet.

    At the very least, I really wasn’t thrilled to learn that I was potentially exposed to Hepatitis C through this website and this fact does not make me inclined to accept this press release at face value. There are a lot of good people at Kink.Com doing the best they can and I adore them as individuals. I cannot help but object when it comes to my own life. I’m pissed that odds are, there is going to be more state interference in porn and that the battle is being fought between producers and outside meddlers. All I’m saying is, it’s time to stop discriminating against performers who opt for condoms. The porn industry isn’t an alcove of society in Los Angeles. Porn is a global business and there is no centralized testing. We’re all jetsetting across the country and the world for work. Testing isn’t enough and the state is knocking. Most performers probably will opt out of condoms but if you stop selecting against those who ask for them, you’ll have something to point to when AHF or Isadore Hall comes asking.

The biggest down side to this press release is that now that Kink.com has publicly come out as being concerned for the safety of it’s “talent”, they will never be able to credibly film a scene where some sweet young girl is – instead of tied up in a dark basement and beaten – tied up in a dark basement and injected with an STD.

    That would be pretty “kinky” (and if you don’t agree, you’re just drawing an arbitrary line in the sand).

  12. @CPanzram: Please don’t bring Katie Summers into this. She is close friends with Rob Black and from where i stand she has a credibility factor of zero. This is a woman who claimed she had NO IDEA of Stagliano’s HIV status (it’s on his damn Wikipedia page!!) and apparently believes HIV can be transmitted by a hand touching the surface of the skin. As for kink.com, I’m not a subscriber nor a fan of most of their content- I already mentioned that my preferences fall on the “vanilla” end- but it’s extremely clear from the clips I’ve seen that any performer who decides to work for kink KNOWS WHAT THEY’RE GETTING INTO. It’s beyond obvious. If someone uses electrostim implements improperly there may be a burn risk. Katie Summers was not some wide-eyed innocent straight off a farm in South Dakota. She consistently paints herself as a victim and refuses to take personal responsibility for any of her choices. Rule #1 for subbing in BDSM scenes: actually be a true submissive- don’t try to fake it for a paycheck. Rule #2: know what you’re getting into. It takes very little research.     Katie Summer says Kink burned her with a cattle prod and that wasn’t something she wanted.

    You said that since she is with Rob she has no credibility. That’s messed up. So, if Katie said she was raped you would deny her claim too? In that instance you don’t disregard a statement of abuse. You check to see if it was true. They have the footage.

    I’ve been involved in the local BDSM communities for a very long time. I even still own a venue that hosts regular parties to them.

    First off, the women in the community that can endure the Kink quality content are often very large women. Some are obese and others are just large. They look nothing like their talent at all. Is Kink.com trying to tell me that the only women and men of that caliber are in San Fran at their armory? I can go to any munch and no one looks like their talent. In fact, apparently only porn girls are the pretty ones getting prodded and beat to shit. Hmmm. Something smells funny.

    Which brings me back to the failed footage. Where is it? If these girls would come to the events I rent out to then they would red-out right away and the scene would be over. You know why? Because she isn’t at risk of losing 11 hundred bucks and future work. Maybe her agent will smack her too. Who knows. He’ll probably just yell at her bunch. That won’t be on her mind during the scene. You have money involved though. Not just on the talent’s part, but the company as well. They have a motive to keep her going and she has one too. They are at risk of having to repay the crew to reshoot. She may wind up being evicted if she doesn’t finish this scene.

    She consented though. So it is all cool, right? I mean, the whore knew she had it coming, right? She knew what she was getting into. She knew that she would require surgery as a result of the scene, right?

    Normal workplaces do not work like this. Rob got sent to jail for filming staged acts and mailing them. His weren’t real. Kink.com’s are. These are obviously people thinking they are above this industry. Therefore, they’ll treat the talent as such.

  16. @CPanzram: What I am saying is that Katie Summers needs to take personal responsibility for her choices. I cannot imagine that she was naive to the point that she was unaware of kink’s content. She should not have consented to do that scene, or work for kink at all. There seem to be performers doing scenes for kink as subs just for the paycheck rather than actually being subs. Bad idea. And if she asked then to stop, which I didn’t see mentioned, then they obviously should have, which DOES make them liable. None of this is clear. My problem with Katie Summers’ credibility is not just her association with Rob Black. That crossed WELL OVER the line between “fake” and “real.” Even Brandon Iron, far from a gentleman himself, called it “the foulest thing (he’d) ever seen on a porn shoot.” Should kink.com turn out to be Satan after all, I place Rob Black on the same level. Yet he acts as if he’s better than they are. And why no mention of infamous misogynist filth like Khan Tusion? How did he somehow get a free pass after allegations of actual coercion, refusing to stop scenes, cast and crew taunting female talent for asking to have a scene stopped. and Ashley Blue’s and Kimberly Kane’s very similar allegations of attempted near-fatal strangulation? In Kane’s case, she wasn’t even DOING A SCENE at the time.

  17. So, you’re going to base the safety of performers on “Well, I think she knew what she was doing.”. Yeah, she should know that a cattle prod can burn you and split the skin. Was she told that? You always have to assume they are naive. How many men and women in adult have you met or worked with? They’re naive.

    Men in general are not interested in seeing larger and curvy women. Some are. In fact, a lot are, but there is a market for the other size as well. Where do Kink find the diehard lifestylers that are hotter than the hottest chick in a local community? Oh, that’s right. They aren’t die-hard lifestylers consenting to these scenes.

    Let’s face it. The girls aren’t into this in their bedrooms or local dungeons except for a very select few.

    If you start shooting nothing but actual lifestylers you will have a product that is hard to sell because they are not visually pleasing.

    You think a performer wants to take the large dick of a guy that she may not be all that into for a 2 hour period? Of course not. So let’s beat her as we do it. That’s the mantra, right?

    I did not know of Stagliano’s HIV status until he got busted and I read about it. I’ve met him once before I knew that. He didn’t look all AIDSY so I wouldn’t have known unless he told me. I was much older than all of these new comer girls too.

    Ignorant or cautious? I mean, we are dealing with lives. If you don’t agree ask the douchey guy from Rocky V. Oh wait, the actor that played him died on Sunday after he contracted HIV. You can’t.

  18. @CPanzram: I don’t see why I should assume that performers are naive. I would expect them to be the OPPOSITE. I won’t work for a company that engages in unethical business practices, so I research them before even considering applying. In a high-risk industry like porn, you should be expected to be even MORE vigilant, not LESS. I DO expect personal responsibility in choosing what you do with your own body. As for diehard BDSM lifestylers, I would imagine that most prefer to keep that to themselves and within their community and NOT appear in commercial pornography. If kink can’t find enough porn stars who ARE actual subs and not just pretending for the paycheck, they either need to work with just that select group that DO enjoy all manner of subbing, and not risk hiring those faking it for the money, or have a competent staff psychologist on hand to evaluate any new talent to make sure they are what they say they are. Would certainly help with any liability issues as well. “He didn’t look all AIDSY so I wouldn’t have known unless he told me.” That’s a rather absurd statement. “AIDSY”? That’s because he DOESN’T HAVE AIDS. HIV does NOT equal AIDS. As I’ve already said, there are people who are HIV+ living for decades without their HIV converting into AIDS. You can’t tell who has HIV by LOOKING at them! I know nothing of the actor you keep referring to, but his death was from AIDS, not from HIV+ status. The two ARE NOT equivalent. Stagliano and Magic Johnson might well outlive you or me.

  20. I don’t think just because a man is bisexual that the person should be limited to gay porn. However, I get your point. Gay porn should test as well with HIV negative performers paired with other HIV negative performers. The same should hold true for HIV positive performers being paired with other HIV positive performers (we should really try this in straight porn as well, actually).

    For the record Wolf Hudson, Jack Hammer and Maestro Stefanos also perform in both gay and straight productions at Kink. Stefanos also fills in from time to time for Sadistic Rope’s director as a production assistant (with no sexual contact between Stefanos and the female talent in these productions). All three are HIV negative and have a large fan base in straight porn. Are you really seriously going to say that they should only do gay porn? Or does the rule only apply to the relatively unknowns that you have on your list. Give me a fucking break!

  21. There is nothing kinky about giving someone VD. Unfortunately it is a side effect of people having polyamorous relationships. In the non-porn kinky world usually tests are exchanged before sexual contact but not always. However, IMO people outside of porn should be able to make decisions for themselves on whether to partake in any sexual activity. That includes whether to exchange tests or not. In porn tests should be exchanged as a matter of course due to talent in most cases not knowing a damn thing about their partner or that person’s morals.
