I don’t normally report on the gay side of the biz but with Treasure Island medias recent run ins with Cal-OSHA maybe the straight side of the biz needs to take a good look at what thier comrades on the gay side are doing.  Im not saying that all gay performers and companies are engaged in this behavior but how many times has the straight side looked the other way when Rob Black or Mark Handel aka Kahn Tusion did the same irresponsible type of shit that eventually got us to exactly where we are with legislation?

I don’t know if Blue Bailey is already positive for HIV or not but if not he is as dumb as a whole warehouse full of hammers.     THE industry presenting gay/straight segments of the industry as separate or distinct industries is like saying BDSM scenes aren’t porn. OSHA compliance is the headline grabber yet DOL in its entirety can’t be discounted in any legislative process. Which means EEOC is also a factor.

  8. I’ve honestly never understood how you have an industry that routinely separates “the industry” into “sub-industries.”

    It happens in fields such as the medical field where you have different specialties such as dermatology, OB/GYN, surgeons, PCP, etc. BUT, they all still encompass “the medical industry” as a whole.

    I would think the “porn industry” would be divided into “fetish” categories, perhaps? But, where is the actual line between what IS and what ISN’T included in “the porn industry.”

    But, this is exactly what happens in self-regulating industries… Anything, and I mean anything, goes…

  17. I read an interview years ago with Paul Morris, founder and president of Treasure Island Media. TIM is more like a cult than a porn studio. Morris’ philosophy is that seroconversion should be seen as a badge of honor, that a man is truly “authentically” gay and rejects all mainstream gay societal conventions. The performers who work for Morris seem to worship him. Many of the men in his films have biohazard-symbol tattoos. It’s seen as a visible sign of HIV+ status and pride in the rejection of assimilation-based (gay marriage, etc.) gay social mores. I sold and rented TIM DVDs years ago as an adult store employee. There were customers who were disgusted by and vehemently opposed to TIM’s “philosophy,” and others who were fascinated by its open transgression- watching others engage in acts that they’d never do themselves. The owner of the store stocked TIM content because he was all about the bottom line. If there was a demand for it, he didn’t care.

  18. I am torn on this question, Jilted. On one hand we have the need to protect people from an untimely torturous death from AIDS but on the other we have free speech concerns and a person’s choice to live their lives as they wish. I would probably support a law stating that if someone is infected with HIV that person cannot perform in adult film without a signed waiver from the HIV negative person stating that he/she knows that their sexual partner has HIV and understands the risk of performing with that person. I also would support a law that affirms the producer’s right not to allow someone that is HIV positive to perform in his/her movies. I would definitely support a clause that states that if someone works with an HIV positive person he/she cannot perform in any more scenes for two months and is put on a quarantine list that is public and accessible during that time.

    If I ran a studio I would research every guy I hired, and if I ever found him going a gay film I would not hire based on the grounds above. Call it “discrimination” all you want, but if your having unprotected sex with guys, you are seriously seriously putting people at risk in community.

  20. I just dont get the free speech argument. The speech belongs to the producer, not the performer. If the speech you want to create demands that someone else be exposed to potentially deadly disease, I just dont think that free speech right trumps the right of the performer to have a safe work place.

    Mainstream movies fake it. Fake guns, fake blood,,,,but porn doesnt fake it. The exposures are real, the disease is real. I just dont think that exposing someone to disease is covered by free speech.

    regarding your waiver idea,,,,you cannot simply agree to break the law. The ADA specifically states that if there is an imminent risk of danger from an employee due to the hiv status of an individual the company has the right not to hire that person for that job. This whole industry argument that they will be forced to hre HIV+ people is simply not true.

  27. I am glad the ADA (which is federal) already allows producers to weed out HIV positive people from performing in porn. However since the argument is that state law doesn’t provide the same protection (and to prevent a court battle when the two laws clash on states rights grounds) California legislators should specifically allow for the practice of excluding HIV positive people from the performer rolls on a producing company basis. However I also have to support the informed choice of the performers to waive protection and be as dumb as a warehouse full of hammers no matter how misguided the decision as only the performer would be a victim (as long as the producing company takes responsibility if the victim comes up HIV positive). As long as it is a truly informed decision not pushed by the producer or a company producing scenes I have trouble with the idea that government is supposed to step in to the situation and force someone to not perform with another person. With the HIV positive scenario in this article above there is more than one victim as only some of the other performers were HIV positive and there would potentially be more than one victim. Next we will be saying that HIV positive people may not have sex at all no matter what the consent situation is (even if the other person is also HIV positive), I cannot in my right mind support something like that.
