Proposition H-8

It’s getting a lot of attention nationally. but for those not following H-8 was the proposition on the California ballot that banned same sex marriages. It passed by a rather thin margin.

Now here’s my problem with this.

Our constitution guarantees that all men and women are treated equally. No state can pass a law that violates this basic principle of equal protection. It isn’t up for a vote no matter how many people vote for it. that’s what separates our version of Democracy (which is really a Constitutional Republic) from Anarchy, ie mob rule.

The rights of the individual HAVE to be protected.

And that is the basic issue here the state has no business recognizing marriage anyway, it’s a religious institution. If your church doesn’t wish to perform gay marriage they have that right, if they do, they have that right as well.

People say they want less government but when something like this comes up they are quick to try to legislate their views onto the lives of everyone.

The point here is that it shouldn’t be illegal, this isn’t a criminal matter and to try and criminalize it is just plain wrong, and most of you know it. There’s a rash of this going around too anti smoking laws is another good example, while you may not want to be exposed to second hand smoke, I can appreciate that but if I own a nightclub and I want to allow people to smoke in my club then that is my right.  if you don’t like it you do not have to patronize my club, there are plenty of clubs that will not allow smoking that you can go to.

We have to stop this nonsense and recognize that people are free to make personal decisions, be it smoking or whom they wish to marry.
