We seem to get into this place a lot on MikeSouth.com. Lots of people threatening to file suits or arguing that someone should file a suit. Since ladyinthestreets is a lawyer, the following primer is not for her benefit – she already knows the law. Rather, its a public service for everyone else who is not a lawyer.
The suit the muscular dude would file against Mike would be a libel and defamation suit, since the allegations were published on a website. Since the article included both statements by Mike as well as an image of a review previously published on another site, Mike is responsible for anything that is false and defamatory in the review. For instance, if the reviewer wasn’t really straddled, that could be false and defamatory. By republishing it, Mike adopts the facts in the article as his own.
The suit would be filed in federal court since you have a diversity of jurisdiction – Mike lives in Georgia; the dude apparently lives in California; and the web article was published everywhere there’s a web browser. He, if it was read in the UK, the dude could potentially file suit in England, where they’re more plaintiff friendly.
Now, as Ladyinthestreets knows, the dude in the ad is a public figure by virtue of his profession – if you get paid to get naked and do the deed in front of the camera as your profession, you’re a public figure for the purposes of nasty things said about you in that context.
As a public figure, he can sue for false and defamatory things written about him. However, he cannot sue on the grounds that those false and defamatory things could potentially cost him income. He has to prove that he lost quantifiable sums of money (and to go to federal court, it has to be at least $10,000) that can be tied back to this publication. There have to be actual, quantifiable damages as a direct result of the publication.
Ah, but there’s more for public figures.
It’s not enough to prove that the facts are wrong. He has to prove that Mike knew the statements were false and published them anyway to intentionally cause him harm.
So, if he can prove that false statements have been made – either directly by Mike or in the review republished by Mike; if he can prove that Mike knew they were false when he published them and did it anyway; if he can prove that he’s lost money as a direct result of the publications; and, if he can find a lawyer willing to file the suit …… then ladyinthestreets is correct. He could be entitled to recover.

2) The monetary threshold for damages to get federal diversity jurisdiction is $75,000, not $10,000.
3) I agree that this guy would probably be considered a public figure, so he’d have to prove that Mike published false statements which he knew to be false or that he recklessly disregarded the likelihood that they were false. I don’t see that here.
4) What are this guy’s damages, really? No way it would ever be worth the money he’d have to spend to file and prosecute the case with such a low chance of winning. The idea that this guy should sue over this is asinine.

From what Mike saw about this guy he has reason to believe that this guy was/is a gay escort and this article was certainly not published recklessly. I think Mr. Ducatti-Danilo at least has a history of being a gay escort if he is not one now. I do agree that the way the system currently works escorts could be a threat to other performers if the johns aren’t tested within a few days of using a porn performer escort’s services. However, I have a hard time telling people they can’t make money escorting (even though in my thoughts I would like to be able to say they need to choose due to the current illegality and the problems due to it), with the downturn in porn and the lack of education among porn performers in general (we do have a fair amount of college grad porn performers but especially on the female side the percentage is far less than half) this may be their best shot at making a decent living. I think prostitution should be legal, regulated and taxed using escort services (and not allowing street walker prostitution). I think with a 14 day VD testing requirement for both johns and prostitutes and a 10% tax assessed to prostitution income to cover the cost of regulation and tracking prostitution would be less dangerous (from both a VD and a safety perspective) as it is less likely that someone would get VD within 14 days than now when it could be years between a john’s VD tests. Legalized escort agencies could also vet potential johns refusing to serve the ones that have violent felonious criminal records and do not have at least a five year span outside of prison and not on probation or parole of not being convicted of violent felonies, not currently charged with one and never having been convicted of murder or forcible rape.

(You’re a lawyer; I work in the media and have been sued for libel in federal court on a couple of occasions, including a lawsuit that included a republication that reset the statute of limitations – in my cases, the suits involved individuals who were found to be public figures. They were never able to demonstrate that I wrote something that was factually wrong (heck, there’s a Fourth Circuit Court Of Appeals ruling that says I did my job) and neither plaintiff was ever able to quantify damages).

You are correct. To get into federal court, the suit either has to involve a constitutional issue, OR total diversity of the parties + amount in controversey is at least $75k. For defamation claims, if it’s a public figure, then the plaintiff has to show that the defendant either knowingly published a false statement or did so with reckless disregard for the truth. For private individuals, it’s a negligence standard.
Honestly, the part about Mike’s post which sounded the diciest to me was the claim that TJ Cummings was running around showing people fake test results, but I imagine he has some sort of backup for that claim.
