Attorneys for President Trump are urging a Los Angeles federal court judge to toss porn star Stormy Daniels‘ lawsuit over a hush money deal after their alleged affair.
Daniels, whose book “Full Disclosure” details her alleged affair with Trump more than a decade ago, seeks to nullify a non-disclosure agreement she signed before the 2016 presidential election. The agreement was an attempt to keep her from speaking out about the one-night stand she allegedly had with Trump.
A second lawsuit, which was moved from New York to Los Angeles last month, accuses Trump of falsely tweeting that the aging porn star lied about being threatened in 2011 to not go public with the story of their alleged relationship.
The start of the nondisclosure agreement lawsuit has been delayed twice. In April, U.S. District Judge S. James Otero ordered a three-month stay in light of a federal criminal investigation of Cohen that is continuing in the Southern District of New York. With that investigation ongoing, Otero agreed in July to extend the stay for another 45 days.
In a cunning move, Trump’s lawyers are expected to argue in a Los Angeles federal court Monday that the agreement and $130,000 payout was not valid and they won’t punish her for breaking it.
“Mr. Trump does not, and will not, contest [Daniels’s] assertion that the settlement agreement was never formed, or in the alternative, should be rescinded,” Trump lawyer Charles Harder wrote the court.
Daniels has sued to escape the agreement so she can speak publicly without fear of reprisal.
Daniels’ lawyer wants to keep the litigation going to take testimony from Trump about whether the deal was inked to silence Daniels while he was running for president.
Trump’s personal lawyer, Michael Cohen, has pleaded guilty to campaign finance violations for arranging payments to both Daniels and a former Playboy model to influence the election.
The civil suit delays were predicated on concerns that any further litigation over the validity of a settlement agreement associated with the $130,000 payment could compromise Cohen’s constitutional rights in the criminal case. With that matter now resolved, the California action figures to move forward.
