That strikes me as reversible error already. Standing is a constitutionally prescribed LIMIT on the jurisdiction of federal courts. Federal courts simply may NOT take a case unless the parties are the proper ones–unless the plaintiff has a real injury in fact, etc.

That the court needs a party to “sharpen the issues” is NOT a permissible way to find standing.

This is way off all constitutional rails already.
