Sports have enforceable rules with punitive consequences. You’re correct that sports use drugs. Team physicians are at every practice and game. Boxers ointment has prescription strengh analgesics and a physician overseeing if not actually administering the treatment.

there is no labor/employment comparison between sports and porn because porn is not going to hire set-physicians nor are there any ‘industry rules’ aka standards or anyone authorized within the industry to enforce the ‘standards’ porn pretends to have.

ICYMI: the NFL is on the hook for concussion damages. TBI (Traumatic brain injury) is changing the sport with refs stopping the clock for injury. Now it’s if there’s a chance of injury stop clock…used to be… get his pansy ass off our fucking field.

Lol…somehow I knew you’d pick up the veiled repetitive injury association. Performers are considered intermittent workers so it’s much harder for them to make a claim than an agency referred keyboard data entry worker…not impossible but definitely much harder.

If a worker makes a claim the employer says not our fault pre-existing repetitive blah blah blah…then WC or OSHA looks at all sorts of stuff to make a determination…..that is why it’s a grey area.

OSHA requires employers to assess, determine and prevent injuries or illnesses their workers are at risk for. They don’t go around like the building, health or fire dept etc. does looking for posted inspection certifications. OSHA relies on the industries themselves or adversarial third parties to bring them proposed policies for consideration.

First, I seem to find myself in arguments like this all the time – and, I have a track record. For over a year, I tried to explain what was going to happen with the court case filed by Vivid. I was lectured to over and over by legal minds who more or less said I was an idiot and didn’t know what I was talking about ….. and then the courts ruled exactly as I’d said they would rule and for the reasons I’d said they would rule that way. Similarly, people have been telling me and Lurk that we just don’t understand porn – it’s different, talent are private contractors, the rules don’t apply, its freedom of choice – and we’ve both explained that employers have responsibilities under the law to provide a safe workplace. It’s not a matter of a worker’s civil rights – that’s the wrong lens through which to view this. The law addresses the employer’s responsibility. That’s a very different thing.

So, using your construction example (which for some reason gets used over and over again), there’s no question but that injuries occur on construction sites. However, that does not obviate the responsibility of the employer to create a safe work environment – workers have to wear hardhats; they have to wear steel toed shoes; they may have to wear safety glasses; they may have to wear protective ear plugs; if they are repeatedly lifting weight, they may have to wear back supports. If a worker injures himself on the job site, the construction company can’t legally give him a pain killer so the worker can ignore the pain, go back to work and risk further injury. Any construction company that did that would be fined like crazy. Moreover, a construction company can’t get around its responsibilities by saying: Yeah, but I paid the guy a bonus to risk injury and gave him pain killers so it didn’t hurt so bad until he got home and it wore off.

So, you’re correct – at least for now, there’s nothing that says a company can’t film a double anal scene. However, under the law, the producer is required to create a safe working environment – if the only way a performer can get through a double anal scene is by the administration of a numbing agent so that he or she can’t feel what’s happening to him or her, the producer and director would probably be liable like crazy if the performer is injured. You can’t create an unsafe work environment that is in violation of the law and then say: Why are you blaming me? It was her choice to get injured.

So, sorry, but just like Kink, James Deen and others are learning, it ain’t about choice if choice is in violation of the law.

IDK seems like a grey area if there are no harmful residual effects or subsequent lost days of paid work. Workers use meds and adaptive technology in many industries. E.g. In places where wrist braces were common it’s the norm to see split keyboards today to reduce WC carpel tunnel claims and OSHA headaches over missed workdays aka reduced paycheck.

You’re absolutely correct that ‘everybody knows what they’re getting into’ defense doesn’t work well with labor regulatory agencies on stuff like this. It works well for firing a worker who refuses to wear an employer provided uniform kind of stuff.

Bottom line if there are enough reported worker injuries or lost paid workdays labor agencies can force changes. Our lawn guy showed up sporting a new safety cage on the commercial mower and all the guys were wearing protective ear covers except when they laid mulch. Was cheaper doing that than paying fines.

What happened to people being adults and saying “I don’t like this ” and saying thanks and I will go work elsewhere? This isn’t a civil rights issue, it’s about choice.

If I don’t want to destroy my back working in a construction career; guess what, I go work somewhere else. I don’t take the job and then moan and groan about how I am being exploited. We have choices and a girl can work for LP or she can work for another porn company; there are plenty out there and there is nothing that is forcing her to do double anal scenes with LP and nothing forcing her to accept a numbing agent if she feels her asshole isn’t loose enough to handle the work.

People in physical jobs take drugs all the time. Pain killers in sports, pain killers for laborers or construction guys, you name it. This isn’t some huge outrage you are making it out to be. It’s a numbing agent for their asshole; they are not injecting them with heroin and turning them into street walking prostitutes.

The reason this is an outrage is that legally “everyone knows what they are getting into” does not comply with labor law. Nor does the fact that anyone is paying them well. Lurk will help me out here, because she knows OSHA regs better than me, but I do not believe you can legally ask someone to do something on the job that is so painful that they cannot perform it without drugs to mask the pain. And that’s because the drugs would numb the sensation to the point that you wouldn’t know you’re being injured, and perhaps seriously injured, until the drugs wear off.
