California’s criminal justice system is terribly slow. Most defense attorneys force their clients to “waive time”, meaning the 85 day limit will not apply to their case. Once you “waive time” in California, you doom yourself to 3-4 years of court bullshit before your trial. Word of advice, make the prosecutors put their case together quickly and don’t “waive time” without seriously thinking about the consequences. IMO in most cases you are just giving the prosecution the time it needs to put you away. Your defense attorney can put together a case a lot faster than the government can, making them bring you to trial within (IIRC) 85 days of arraignment will weaken their case. The SCOTUS ruled you have the right to a speedy trial, use it.
