A judge today has denied the motion to have AHF removed from Vivids condom lawsuit. meaning that AHF will maintain it’s intervener status in the suit.
In his order, Judge Pregerson wrote, “Because the Defendants (Los Angeles County officials) refuse to defend Measure B’s constitutionality, Interveners are needed to sharpen the issues this Court will be required to answer. …For the reasons stated herein, the Motion is DENIED.”

That strikes me as reversible error already. Standing is a constitutionally prescribed LIMIT on the jurisdiction of federal courts. Federal courts simply may NOT take a case unless the parties are the proper ones–unless the plaintiff has a real injury in fact, etc.
That the court needs a party to “sharpen the issues” is NOT a permissible way to find standing.
This is way off all constitutional rails already.
Although, I suppose AHF is not the plaintiff here…so then maybe there is a different calculus for standing here.
Still, seems fishy to me.
