Right now there is a new law (H.R. 1865) currently in the works that would make advertising prostitution on social media a federal crime.
It’s more than just about sites like Backpage, it could even mean promoting your “tour” on social media could get you in some serious trouble.

H.R. 1865 is a modification to the Communications Act of 1934 — which they are calling the “Allow States and Victims to Fight Online Sex Trafficking Act of 2017“. But in reality, it’s less about sex trafficking and more about giving the feds the power to stop the promotion of prostitution using social media.
If H.R. 1865 becomes law, the FBI would be able to prosecute Facebook, Twitter, Snapchat, Instagram, Craigslist, and myriad other sites where sex workers advertise and/or communicate with clients—even if the sexual exchange is only alluded to and never completed.
Social media has revolutionized the sex trade, making it much more possible for women to screen clients before seeing them; and to generally take more control over their bodies, businesses, and personal safety.
It passed the House with a vote of 388 to 25 on February 27, 2018. On March 1st the Senate placed the bill on the Legislative Calendar for Monday. It is expected to be voted on by the Senate on Monday, March 5th.
If you read the bill, no matter what they say, it is not about fighting sex trafficking. It’s clearly meant to stop people from being able to advertise escorting services using social media or sites like Backpage.
So next time you want to tweet about a “tour” you are on, might want to give that a second thought. That simple tweet might land you in jail.
