” It is unfortunate that in the various meetings that the industry has had with my office, the industry has never offered a single reasonable suggestion to universally protect its workers and now opposes the very STD testing protocol that they developed and inconsistently use. That is not showing leadership, it shows the Legislature and the public that the industry is more concerned with increasing their profits than protecting its workers.”

SACRAMENTO, CA – Legislation by Assemblymember Isadore Hall, III (D – Los Angeles) to require documentation of condom or other personal protective equipment use in California produced adult films and mandatory employer paid STD testing of adult film actors was approved today by the California State Senate Labor & Industrial Relations Committee. AB 1576 passed on a vote of 3 to 1.

 

After the hearing, Hall released the following statement:

“Today, the Members of the Senate Labor & Industrial Relations Committee overwhelmingly saw beyond the adult film industry’s flaccid misinformation campaign and took decisive action to protect these actors in the workplace.

 

I want to thank the many actors that testified in support of AB 1576, especially Ms. Sophia Delgado, who courageously came forward today to announce that she was the third of five adult film actors to have contracted HIV in 2013.  She, along with former actors Cameron Bay, Rod Daily and others have shown an incredible amount of character to be able to share their very personal challenges in hopes of saving the lives of others.

 

My office has and will continue to listen to members of the industry and the public on this important issue. It is unfortunate that in the various meetings that the industry has had with my office, the industry has never offered a single reasonable suggestion to universally protect its workers and now opposes the very STD testing protocol that they developed and inconsistently use. That is not showing leadership, it shows the Legislature and the public that the industry is more concerned with increasing their profits than protecting its workers.

 

The adult film industry is a legitimate, legal business. It is time for the industry to stop deceiving the public and start acting like every other legitimate legal business in California. Legitimate businesses follow the law. Legitimate businesses protect their employees from injury and harm in the workplace. The State of California has a responsibility is to protect all of its workers from injury and harm in the workplace.  The Senate’s actions today reaffirm that commitment and we look forward to bringing this measure to the full Senate for consideration in the coming weeks.”

 

AB 1576 now heads to the Senate Appropriations Committee for further action.

  1. I would have to agree. There really hasn’t been one solution brought forth other than condoms.

    Legislators obviously recognize the flaws within the basic harm reduction testing system so what’s the solution? Until the industry can actually come up with one, I don’t see anyone’s opinions changing…

    OSHA has determined their solution. If the industry doesn’t agree with the solution proposed by OSHA then it may be a good idea to actually come up with an alternate solution instead of complaining about the only single preventive measure brought forth to date.

    Performers keep insisting that they’re not being heard. I try to listen to them. I just have no idea what they’re trying to communicate other than “No one listens to us.”

    They say the testing system works. Others disagree and provide proof to back it up.
    What am I missing? Did performers propose a solution I failed to see? If so, where the fuck is it?

    Porn has brought this on itself. If it had continued to act as it did in the 80’s and 90’s, when there was self-regulation and self-restraint, porn probably wouldn’t be in this predicament.

Most people probably get a $300 to $20K bill (depends on the company that caught the pirate) from a copyright attorney before they have downloaded 50 movies now that the companies can track who downloads their movies illegally. Recently Mike posted a link to a blog where one attorney’s MO is explained. Nowadays tube sites cost more than actually obtaining your porn legitimately.

    Gotta love the…we didn’t have input..nobody consulted us..talking points. Especially how two things in the hearing directly contradicted that party line.

    Duke comments…CDC is not stringent like our protocol. We already have a baseline (referring to lack of CDC industry specific recommendations) and have been working with OSHA for two years.

    Ooops seems she overlooked a couple years. The process to amend OSHA BBP policy 5193 started in 2009 with the advisory board process started within three months. Besides the regular open meetings publicized to solicit performer input FSC/stakeholders or their legal reps had numerous other advisory meetings with OSHA right up until the draft OPIM policy was made public prior to usual process of waiting until the upcoming public comment/input phase to release the draft.

    The second part was during committee comments where discussion focused on how this bill is a mirror to OSHA policy. If 9th circuit agrees with industry that condoms are unconstitutional the bill would stand and support OSHA as a tool for mandated record keeping/documentation and employer paid testing.

    For Performers telling anyone who might hear them…nobody asked us…why aren’t you asking the performers, directors, producers etc that were around between 1992 and 2009 why they didn’t work with OSHA or anyone else to create a viable solution to prevent the last five years of expensive & ugly regulatory battles? Or ask them what they said in closed door meetings with OSHA between 2009 & 2013 then you can even check OSHA site meeting minutes to see if what they tell you is what they really said 😉
